01Acceptance of Terms
By accessing or using the QNSET Software Development website, applications, and services (the "Services"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Services. We may update these Terms at any time, and continued use after changes means you accept the revised Terms.
02Eligibility and Accounts
You must be at least 18 years old to create an account. When you register, you agree to provide accurate information and to keep it up to date.
- You are responsible for all activity that occurs under your account.
- You must keep your password secure and notify us immediately of any unauthorized use.
- Accounts that remain inactive for 24 consecutive months may be automatically deleted, along with associated data.
- We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk.
03Description of Services
QNSET provides custom software development, managed application hosting, infrastructure management, and related engineering services. Access to some features requires registration. Commercial work is performed under separate Statements of Work or Service Agreements that reference these Terms.
04Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation.
- Infringe the intellectual property or privacy rights of others.
- Distribute malware, viruses, or other harmful code.
- Attempt unauthorized access to systems, accounts, or data.
- Run resource-intensive workloads without prior written approval.
- Harass, abuse, or harm others.
05Intellectual Property
QNSET retains ownership of all pre-existing software, tools, frameworks, and methodologies. Custom software developed specifically for you becomes your property upon full payment, unless otherwise stated in a separate agreement. You grant QNSET a limited license to use your trademarks and logos solely for the purpose of delivering the Services.
06Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information disclosed during the engagement. This obligation survives termination of these Terms for a period of five (5) years, except for information that is publicly available, already known, or independently developed.
07Payment and Billing
Where applicable:
- Subscription fees are billed in advance on a monthly or annual basis.
- Custom development is billed according to the executed Statement of Work.
- Services may be suspended when payment is more than 15 days overdue.
- Fees are non-refundable except where required by law.
08Account Termination and Data Deletion
You may delete your account at any time by contacting us. We may also suspend or terminate access immediately for violations of these Terms or for security reasons. Accounts inactive for 24 consecutive months are subject to automatic deletion. Upon termination, we will provide your data in a standard format where feasible, unless retention is required by law.
09Service Level and Support
For managed hosting customers, we target 99.9% monthly uptime. Downtime does not include scheduled maintenance, force majeure events, or issues caused by your code or configuration. Support is provided through the channels described in your service agreement.
10Limitation of Liability
To the maximum extent permitted by law, QNSET shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount paid by you to QNSET in the twelve (12) months preceding the event that gave rise to liability.
11Governing Law and Disputes
These Terms are governed by the laws of the Republic of Türkiye. Any dispute arising from these Terms or the Services shall be resolved through binding arbitration in Ankara, Türkiye. For EU data subjects, nothing in this clause limits your rights under the GDPR to bring proceedings in your member state of residence.
